- Acknowledgement: As a condition of participating in the Sweepstakes, you agree to be fully and unconditionally bound by these 6/11/26 My Stat Sheet Soccer Jersey Giveaway Sweepstakes Official Rules (“Official Rules”), the DraftKings General Rules (“General Rules”), and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and you agree to fully and unconditionally waive any right to claim ambiguity in the Sweepstakes, the Official Rules, or the General Rules. - Entry Period: The Sweepstakes begins at 9:00:00 AM on June 11, 2026 and ends at 11:59:59 PM on June 19, 2026 (the “Entry Period”). All references to time of day contained in these Official Rules refer to the Eastern Time Zone. Sponsor’s computer shall be the official clock for all purposes of the Sweepstakes.
- Eligibility: The Sweepstakes is open only to individual legal residents of the United States who, at the time of entry into the Sweepstakes: (i) meet the age eligibility requirement applicable to the DraftKings account they are utilizing to enter the Sweepstakes and applicable to the jurisdiction from which they are entering (see details below); (ii) are physically located within a jurisdiction in which the DraftKings account they are utilizing to enter the Sweepstakes is offered (see details below); (iii) have a valid DraftKings online sportsbook, online casino, daily fantasy, or Pick6 account in good standing; (iv) are not voluntarily (i.e., self-exclusion) or involuntarily excluded from play on DraftKings platforms; (v) are not included on any jurisdiction-wide gaming or daily fantasy sports exclusion list; (vi) are not temporarily or permanently banned from playing on any DraftKings website or mobile application; (vii) maintain any other DraftKings accounts in good standing; and (viii) satisfy all other requirements contained herein. Potential entrants must meet the following eligibility requirements corresponding to the DraftKings account to which such potential entrant is utilizing:

- for potential entrants utilizing their DraftKings Sportsbook account to enter pursuant to Section 6, such potential entrants must, at the time of entry into the Sweepstakes, be: (1) at least twenty-one (21) years of age, except for individuals physically located in the states of New Hampshire or Wyoming, in which case individuals must be at least eighteen (18) years of age,; and (2) physically located in a state in which Sponsor offers its online Sportsbook product (for a list of states in which Sponsor offers its online Sportsbook product, see https://sportsbook.draftkings.com/help/sports-betting/where-is-sports-betting-legal); and
- For potential entrants utilizing their DraftKings Casino account to enter pursuant to Section 6, such potential entrants must, at the time of entry into the Sweepstakes, be: (1) at least twenty-one (21) years of age; and (2) physically located in a state in which Sponsor offers its online Casino product (for a list of states in which Sponsor offers its online Casino product, see https://casino.draftkings.com/where-is-online-gambling-legal).
Entrants must at all times during the Sweepstakes abide by and satisfy all requirements in these Official Rules and the General Rules. Employees, officers, and directors of Sponsor and each of Sponsor’s affiliates, agents, and advertising, public relations, and promotional agencies, and members of each of the preceding’s immediate families (i.e., spouses, parents, children and siblings, and their respective spouses) and those living in the same household are not eligible to enter the Sweepstakes.
- Limit: one (1) entry per person. Anyone found to be using multiple accounts to enter the Sweepstakes will be deemed ineligible for the Sweepstakes, and all of their entries may be deemed void. Automated and/or third-party entries are prohibited and will be disqualified. Multiple entrants are not permitted to share the same email address or DraftKings account. Any attempt by any entrant to obtain entries by using multiple and/or different identities, forms, registrations, addresses, or any other method will void all of such entrant’s entries, and such entrant may be disqualified at Sponsor’s sole discretion. In the event of a dispute as to the identity of an entrant, the authorized account holder of the DraftKings account associated with the entry will be deemed to be the proper entrant. The potential winner may be required to show proof of being the authorized DraftKings account holder. Entries specifying an invalid, non-working, or inactive email address may be disqualified and ineligible to win.
- Prizes and Odds of Winning: Odds of winning depend on the number of eligible entries received during the Entry Period. Subject to verification of eligibility and compliance with these Official Rules and the General Rules, five (5) winners of the Sweepstakes will receive one (1) soccer jersey signed by Alex Morgan, the exact soccer jersey to be chosen by Sponsor in its sole and absolute discretion (the “Prize”).

Prize Restrictions: Notwithstanding anything to the contrary contained in these Official Rules, Sponsor reserves the right to substitute the Prize with an equivalent prize of equal or greater value. In the event a potential winner cannot be contacted or does not respond within twelve (12) hours, an alternate potential winner may be selected

- Conflict Between Rules: These DraftKings General Rules apply to the Sweepstakes offered by Sponsor except to the extent modified or superseded by the Official Rules. In the event that any provision of the Official Rules conflicts with any provision of the General Rules, the terms of the Official Rules shall prevail with respect to such matter. Sponsor reserves the right to interpret the rules of the Sweepstakes in its sole discretion, and such interpretation shall be binding upon all participants.
- Entry Restrictions: Any forms of entry other than those described in the Official Rules, including, without limitation, multiple submissions, submissions using a false identity, submissions made by/on behalf of another individual, or submissions made through the use of a device or artifice to generate multiple submissions are void. False or deceptive submissions or acts may render an entrant ineligible to participate in the Sweepstakes, and Sponsor reserves the right to disqualify from the Sweepstakes any entrant who attempts to undermine the legitimate operation of the Sweepstakes, acts in a disruptive manner, or violates these General Rules or the Official Rules. - Selection of Winners: The potential winner(s) for the Sweepstakes will be determined from all eligible entries received during the Entry Period. The potential winner(s) of the Sweepstakes will be notified according to the Official Rules for the Sweepstakes.
- Winner Verification: Potential winner(s) are subject to verification of eligibility and compliance with these General Rules and the applicable Official Rules. Except where prohibited by law, potential prize winner(s) may be required to complete and return an affidavit of eligibility and liability and publicity release (“Affidavit”) within the time period set forth in Sponsor’s notification. In the event a potential prize winner: (i) cannot be reached for whatever reason after a reasonable effort has been exerted or a winner notification or Affidavit is returned as undeliverable; (ii) declines or cannot accept, receive, or use a prize for any reason; (iii) does not respond within any specified or applicable time periods; (iv) is found to be ineligible to enter the Sweepstakes or receive a prize; (v) cannot or does not comply with these General Rules and/or the applicable Official Rules; or (vi) fails to fulfill the Affidavit-related obligations, such potential prize winner may be disqualified from the Sweepstakes, and an alternate potential prize winner may be selected, at Sponsor’s sole discretion, even in the event the disqualified potential prize winner’s name has been publicly announced. In the event Sponsor decides to select an alternate potential prize winner, the alternate will be determined from all eligible entries received during the Entry Period and notified according to the Official Rules for the Sweepstakes. - Prize Restrictions: Each prize will be awarded only in the event the potential prize winner fully complies with these General Rules and the applicable Official Rules. No transfer, refund, cash redemption, substitution, replacement, or cash equivalent for a prize will be made. Sponsor reserves the right, at its sole discretion, to substitute any prize for another prize of equal or greater value for any reason.
Sponsor shall have no responsibility or obligation to a potential prize winner who is unable or unavailable to, or who does not for any reason, accept or utilize their prize. In the event of non-compliance with these General Rules or the Official Rules, or in the event a prize is unclaimed or returned as undeliverable, the prize will be forfeited. A forfeited prize may be awarded to an alternate potential prize winner, at Sponsor’s sole discretion. Taxes and fees associated with a prize, if any, are the sole responsibility of the prize winner. Sponsor is responsible only for prize delivery and expressly disclaims responsibility for prize utility, quality, or otherwise.

- Publicity Rights and Use of Personal Information: Except where prohibited by law, by participating in the Sweepstakes offered by Sponsor or accepting a prize, you grant Sponsor and/or Sponsor’s designees the right to use your name, photograph, likeness, statements, biographical information, voice, city and state address, and other identifying information for advertising and promotional purposes for the Sweepstakes in which you participated as well as any other advertising and promotional purposes, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification, or permission. By participating in the Sweepstakes offered by Sponsor or accepting a prize, you acknowledge that you will be sharing your personal information with Sponsor, and you agree that Sponsor may use your personal information for marketing and other purposes. - Choice of Law and Disputes: The Sweepstakes will be governed by the internal laws of the Commonwealth of Massachusetts. Any and all legal actions or claims arising in connection with the Sweepstakes must be brought in a court of competent jurisdiction within the Commonwealth of Massachusetts. Sponsor reserves the right at its sole discretion to disqualify any individual who is found to be (i) acting in violation of these General Rules and/or the applicable Official Rules or (ii) acting in an unsportsmanlike or disruptive manner, with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or with the intent to annoy, abuse, threaten, or harass any other person.
Sponsor reserves the right to amend these General Rules or the Official Rules at any time, and it is your responsibility to review these General Rules and the Official Rules for any changes. By participating in the Sweepstakes or accepting a prize after we change these General Rules or the Official Rules, you accept all changes thereto.
Sponsor may reschedule, delay, postpone, alter, or modify the Sweepstakes, or cancel the Sweepstakes altogether, in the event Sponsor determines, in its sole discretion, that the Sweepstakes cannot continue as contemplated. Without limiting the foregoing, in the event of a Force Majeure Event (as defined below), Sponsor may reschedule, delay, postpone, alter, or modify the Sweepstakes, or may cancel the Sweepstakes altogether. Los posibles participantes deberán cumplir con los siguientes requisitos de elegibilidad correspondientes a la cuenta de DraftKings que estén utilizando para participar:
- Para los posibles participantes que utilicen su cuenta de DraftKings Fantasy para participar de conformidad con la Sección 6, dichos participantes deberán, al momento de participar en el Sorteo: (1) tener al menos dieciocho (18) años de edad, excepto las personas que se encuentren físicamente en los estados de Alabama o Nebraska, quienes deberán tener al menos diecinueve (19) años de edad, y excepto las personas que se encuentren físicamente en los estados de Arizona, Iowa, Luisiana, Massachusetts o Virginia, quienes deberán tener al menos veintiún (21) años de edad; y (2) encontrarse físicamente en un estado en el que el Patrocinador ofrezca su producto Daily Fantasy (para consultar la lista de estados en los que el Patrocinador ofrece su producto Daily Fantasy, visite https://www.draftkings.com/where-is-draftkings-legal);
- Para los posibles participantes que utilicen su cuenta de DraftKings Pick6 para participar de conformidad con la Sección 6, dichos participantes deberán, al momento de participar en el Sorteo: (1) tener al menos dieciocho (18) años de edad, excepto las personas que se encuentren físicamente en los estados de Alabama o Nebraska, quienes deberán tener al menos diecinueve (19) años de edad, y excepto las personas que se encuentren físicamente en los estados de Arizona, Massachusetts o Virginia, quienes deberán tener al menos veintiún (21) años de edad; y (2) encontrarse físicamente en un estado en el que el Patrocinador ofrezca su producto Pick6 (para consultar la lista de estados en los que el Patrocinador ofrece su producto Pick6, visite https://pick6.draftkings.com/where-is-pick6-available);
- Para los posibles participantes que utilicen su cuenta de DraftKings Sportsbook para participar de conformidad con la Sección 6, dichos participantes deberán, al momento de participar en el Sorteo: (1) tener al menos veintiún (21) años de edad, excepto las personas que se encuentren físicamente en los estados de New Hampshire o Wyoming, quienes deberán tener al menos dieciocho (18) años de edad; y (2) encontrarse físicamente en un estado en el que el Patrocinador ofrezca su producto Sportsbook en línea (para consultar la lista de estados en los que el Patrocinador ofrece su producto Sportsbook en línea, visite https://sportsbook.draftkings.com/help/sports-betting/where-is-sports-betting-legal); y
- Para los posibles participantes que utilicen su cuenta de DraftKings Casino para participar de conformidad con la Sección 6, dichos participantes deberán, al momento de participar en el Sorteo: (1) tener al menos veintiún (21) años de edad; y (2) encontrarse físicamente en un estado en el que el Patrocinador ofrezca su producto Casino en línea (para consultar la lista de estados en los que el Patrocinador ofrece su producto Casino en línea, visite https://casino.draftkings.com/where-is-online-gambling-legal).
Los participantes deberán, en todo momento durante el Sorteo, cumplir y satisfacer todos los requisitos establecidos en estas Reglas Oficiales y en las Reglas Generales. Los empleados, directivos y directores del Patrocinador, así como de cada una de las filiales, agentes y agencias de publicidad, relaciones públicas y promoción del Patrocinador, y los miembros de la familia inmediata de cualquiera de las personas anteriormente mencionadas (es decir, cónyuges, padres, hijos y hermanos, así como sus respectivos cónyuges), y aquellas personas que residan en el mismo hogar, no son elegibles para participar en el Sorteo.
- Cómo Participar: Solo existe un (1) método de participación para el Sorteo. Para participar en el Sorteo, usted debe: (A) visitar la página “Recompensas” en la cuenta de DraftKings correspondiente, desplazarse hasta la promoción identificada como la promoción del Sorteo y hacer clic en “Participar”; y (B) visitar la sección “Mi Hoja de Estadísticas” dentro de su cuenta de DraftKings. Ambos pasos deben completarse para participar en el Sorteo. Para visitar la página “Mi Hoja de Estadísticas” en su cuenta de DraftKings, inicie sesión en su cuenta de DraftKings, haga clic en el botón de su perfil y luego haga clic en la pestaña “Mi Hoja de Estadísticas”. Si no tiene una cuenta de DraftKings, puede crear una visitando www.draftkings.com, haciendo clic en el botón “Regístrate” y siguiendo las instrucciones para la creación de la cuenta. La creación de una cuenta de DraftKings es gratuita. Para mayor claridad, no puede participar en el Sorteo a través de la aplicación móvil DraftKings Predictions ni de la aplicación móvil DK Horse, y visitar la página “Mi Hoja de Estadísticas” desde la aplicación móvil DraftKings Predictions o la aplicación móvil DK Horse no calificará como una participación válida en el Sorteo. Pueden aplicarse los cargos normales de acceso a Internet, telefonía y uso impuestos por su proveedor de servicios de Internet o telefonía. En caso de que participe mediante un dispositivo móvil utilizando la red de su proveedor de servicios inalámbricos, podrán aplicarse los cargos estándar por uso de datos de dicho proveedor.
- Límite: Una (1) participación por persona. Cualquier persona que sea descubierta utilizando múltiples cuentas para participar en el Sorteo será considerada no elegible para el Sorteo, y todas sus participaciones podrán considerarse nulas. Se prohíben las participaciones automatizadas y/o realizadas por terceros, y serán descalificadas. No se permite que varios participantes compartan la misma dirección de correo electrónico ni la misma cuenta de DraftKings. Cualquier intento por parte de un participante de obtener participaciones utilizando múltiples y/o diferentes identidades, formularios, registros, direcciones o cualquier otro método anulará todas las participaciones de dicho participante, y este podrá ser descalificado a la entera discreción del Patrocinador. El Patrocinador no será responsable de ningún problema que ocurra durante el proceso de participación, incluidos, entre otros, participaciones tardías, incompletas, demoradas, no entregadas, enviadas a un destinatario incorrecto o inválidas. Asimismo, el Patrocinador no tendrá obligación alguna de informar a un participante sobre una participación o envío tardío, incompleto, demorado, no entregado, enviado a un destinatario incorrecto o inválido. No se aceptarán participaciones ilegibles, incompletas, falsificadas o alteradas. Todas las participaciones pasarán a ser propiedad exclusiva del Patrocinador y no serán reconocidas ni devueltas. En caso de disputa respecto de la identidad de un participante, el titular autorizado de la cuenta de DraftKings asociada con la participación será considerado el participante legítimo. Al posible ganador se le podrá exigir que demuestre ser el titular autorizado de la cuenta de DraftKings. Las participaciones que incluyan una dirección de correo electrónico inválida, inoperante o inactiva podrán ser descalificadas y no serán elegibles para ganar.
- Premios y Probabilidades de Ganar: Las probabilidades de ganar dependen del número de participaciones elegibles recibidas durante el Período de Participación. Sujeto a la verificación de elegibilidad y al cumplimiento de estas Reglas Oficiales y de las Reglas Generales, cinco (5) ganadores del Sorteo recibirán una (1) camiseta de fútbol autografiada por Alex Morgan, cuya camiseta específica será seleccionada por el Patrocinador a su entera y absoluta discreción (el “Premio”).

Restricciones del Premio: Sin perjuicio de cualquier disposición en contrario contenida en estas Reglas Oficiales, el Patrocinador se reserva el derecho de sustituir el Premio por otro premio equivalente de igual o mayor valor. Todos y cada uno de los impuestos federales, estatales y locales aplicables, así como todos los cargos y gastos relacionados con la aceptación y el uso de un Premio que no estén específicamente indicados en el presente documento, serán responsabilidad exclusiva de los ganadores. Los Premios no podrán ser sustituidos, cedidos, transferidos ni canjeados por dinero en efectivo por el ganador (salvo los componentes en efectivo de los premios en relación con cualquier restricción de canje por efectivo); sin embargo, el Patrocinador se reserva el derecho de realizar sustituciones por premios equivalentes a su discreción. El Patrocinador no reemplazará ningún Premio perdido o robado. El Premio se otorga “TAL CUAL”. Únicamente estará disponible para ser ganado en el Sorteo el número de Premios indicado en estas Reglas Oficiales. En caso de que, debido a un error de impresión u otro error, se reclamen más Premios que la cantidad establecida en estas Reglas Oficiales, el(los) ganador(es) del Premio será(n) seleccionado(s), de conformidad con el método de selección de ganadores descrito en estas Reglas Oficiales, entre todos los reclamantes elegibles que hayan presentado reclamaciones aparentemente válidas, con el fin de otorgar la cantidad de Premios anunciada y disponible.
El Patrocinador no será responsable por ningún retraso o cancelación en la entrega del Premio debido a circunstancias imprevistas o fuera de su control. Pueden aplicarse restricciones, condiciones y limitaciones adicionales.
- Selección de los Ganadores: En o alrededor del 19 de junio de 2026, el Patrocinador seleccionará al azar a los posibles ganadores del Premio entre todas las participaciones elegibles recibidas durante el Período de Participación. El Patrocinador notificará a los posibles ganadores por correo electrónico a la dirección de correo electrónico asociada con la cuenta de DraftKings utilizada por dichos posibles ganadores para participar en el Sorteo. En caso de que no sea posible contactar a un posible ganador o que este no responda dentro de las doce (12) horas siguientes, podrá seleccionarse un posible ganador alternativo.
- Preguntas: En caso de que tenga alguna pregunta relacionada con el Sorteo, envíe un correo electrónico a support@draftkings.com con el asunto “Sorteo de Camiseta de Fútbol Mi Hoja de Estadísticas del 6/11/26”. Ninguna respuesta por correo electrónico proporcionada conforme a lo anterior podrá sustituir, modificar o alterar de cualquier otra manera estas Reglas Oficiales o las Reglas Generales.
- Lista de Ganadores: Para obtener cualquier lista de ganadores exigida por la ley, envíe un sobre con su nombre y dirección, con franqueo pagado (salvo que la legislación local disponga lo contrario), a: DraftKings, 222 Berkeley St., 5th Floor, Boston, MA 02116, Attn.: Lista de Ganadores Sorteo de Camiseta de Fútbol Mi Hoja de Estadísticas del 6/11/26. Todas dichas solicitudes deberán recibirse dentro de los tres (3) meses siguientes a la finalización del Sorteo.
LA INFORMACIÓN QUE USTED PROPORCIONE SOLO SE UTILIZARÁ DE CONFORMIDAD CON ESTAS REGLAS OFICIALES, LAS REGLAS GENERALES DE DRAFTKINGS Y EL AVISO DE PRIVACIDAD DEL PATROCINADOR, DISPONIBLE EN https://www.draftkings.com/help/privacynotice.
ANEXO A
REGLAS GENERALES DE DRAFTKINGS
NO ES NECESARIA NINGUNA COMPRA PARA PARTICIPAR O GANAR. UNA COMPRA NO AUMENTARÁ SUS POSIBILIDADES DE GANAR. NULO DONDE ESTÉ PROHIBIDO O RESTRINGIDO POR LA LEY.
- Conflicto entre reglas: Estas Reglas Generales de DraftKings se aplican al Sorteo ofrecida por el Patrocinador, salvo en la medida en que sean modificadas o sustituidas por las Reglas Oficiales. En caso de que alguna disposición de las Reglas Oficiales entre en conflicto con alguna disposición de las Reglas Generales, prevalecerán los términos de las Reglas Oficiales con respecto a dicho asunto. El Patrocinador se reserva el derecho de interpretar las reglas del Sorteo a su entera discreción, y dicha interpretación será vinculante para todos los participantes.
- Restricciones de participación: Cualquier forma de participación distinta de las descritas en las Reglas Oficiales, incluyendo, sin limitación, envíos múltiples, envíos realizados utilizando una identidad falsa, envíos realizados por o en nombre de otra persona, o envíos efectuados mediante el uso de un dispositivo o artificio para generar múltiples participaciones, será nula. Los envíos o actos falsos o engañosos podrán hacer que un participante sea considerado no elegible para participar en el Sorteo, y el Patrocinador se reserva el derecho de descalificar del Sorteo a cualquier participante que intente socavar el funcionamiento legítimo del Sorteo, actúe de manera disruptiva o infrinja estas Reglas Generales o las Reglas Oficiales. En caso de existir una disputa sobre la identidad de un participante, la entrada se considerará enviada por el titular autorizado de la cuenta de DraftKings asociada con la entrada. El Patrocinador se reserva el derecho de exigir a los participantes que demuestren que son los titulares autorizados de la cuenta. Todas las entradas pasarán a ser propiedad del Patrocinador y no serán reconocidas ni devueltas. El participante es responsable de todos los cargos en línea incurridos con cualquier proveedor de servicios de Internet y/o proveedor de servicios inalámbricos.
- Selección de ganadores: El(los) posible(s) ganador(es) del Sorteo se determinará(n) entre todas las entradas elegibles recibidas durante el Período de Participación. El(los) posible(s) ganador(es) del Sorteo será(n) notificado(s) de conformidad con las Reglas Oficiales del Sorteo.
- Verificación del ganador: El(los) posible(s) ganador(es) estará(n) sujeto(s) a la verificación de elegibilidad y al cumplimiento de estas Reglas Generales y de las Reglas Oficiales aplicables. Salvo donde la ley lo prohíba, al(los) posible(s) ganador(es) del premio se le(s) podrá exigir que complete(n) y devuelva(n) una declaración jurada de elegibilidad y exención de responsabilidad y publicidad (la “Declaración Jurada”) dentro del plazo establecido en la notificación del Patrocinador. En el caso de que un posible ganador del premio: (i) no pueda ser contactado por cualquier motivo después de que se haya realizado un esfuerzo razonable o que una notificación de ganador o la Declaración Jurada sea devuelta como no entregable; (ii) rechace o no pueda aceptar, recibir o utilizar un premio por cualquier motivo; (iii) no responda dentro de los plazos especificados o aplicables; (iv) se determine que no es elegible para participar en el Sorteo o recibir un premio; (v) no pueda o no cumpla con estas Reglas Generales y/o con las Reglas Oficiales aplicables; o (vi) no cumpla con las obligaciones relacionadas con la Declaración Jurada, dicho posible ganador del premio podrá ser descalificado del Sorteo y podrá seleccionarse un posible ganador alterno, a la entera discreción del Patrocinador, incluso en el caso de que el nombre del posible ganador descalificado haya sido anunciado públicamente. En el caso de que el Patrocinador decida seleccionar un posible ganador alterno, este se determinará entre todas las entradas elegibles recibidas durante el Período de Participación y será notificado de conformidad con las Reglas Oficiales del Sorteo. El Patrocinador se reserva el derecho de repetir este proceso hasta que un posible ganador alterno cumpla con todos los requisitos de elegibilidad y verificación. El Patrocinador también se reserva el derecho de modificar los procedimientos de notificación y de la Declaración Jurada en relación con la selección de un ganador alterno, si lo hubiera, a su entera discreción.
EL(LOS) POSIBLE(S) GANADOR(ES) DEL PREMIO ESTÁ(N) SUJETO(S) A VERIFICACIÓN POR PARTE DEL PATROCINADOR. LAS DECISIONES DEL PATROCINADOR EN RELACIÓN CON LA ADMINISTRACIÓN Y OPERACIÓN DEL SORTEO, CUALQUIER MODIFICACIÓN A ESTAS REGLAS GENERALES O A LAS REGLAS OFICIALES, Y LA SELECCIÓN Y VERIFICACIÓN DEL(LOS) POSIBLE(S) GANADOR(ES) DEL PREMIO SERÁN DEFINITIVAS Y VINCULANTES PARA CADA PARTICIPANTE EN TODOS LOS ASPECTOS RELACIONADOS CON EL SORTEO.
- Restricciones de los premios: Cada premio se otorgará únicamente en caso de que el posible ganador del premio cumpla plenamente con estas Reglas Generales y con las Reglas Oficiales aplicables. Todos los detalles de los premios quedan a la entera discreción del Patrocinador, y cualquier representación de los premios, ya sea en materiales promocionales o de otro tipo, se realiza únicamente con fines ilustrativos. No se permitirá la transferencia, reembolso, canje por dinero, sustitución, reemplazo ni equivalente en dinero de ningún premio. El Patrocinador se reserva el derecho, a su entera discreción, de sustituir cualquier premio por otro de valor igual o mayor por cualquier motivo.
El Patrocinador no tendrá responsabilidad ni obligación alguna frente a un posible ganador del premio que no pueda o no esté disponible para aceptar o utilizar su premio, o que por cualquier motivo no lo acepte o utilice. En caso de incumplimiento de estas Reglas Generales o de las Reglas Oficiales, o en caso de que un premio no sea reclamado o sea devuelto como no entregable, el premio será perdido. Un premio perdido podrá otorgarse a un posible ganador alterno, a la entera discreción del Patrocinador. Los impuestos y tarifas asociados con un premio, si los hubiera, serán responsabilidad exclusiva del ganador del premio. El Patrocinador es responsable únicamente de la entrega del premio y renuncia expresamente a cualquier responsabilidad relacionada con la utilidad, calidad o cualquier otro aspecto del premio.
TODOS LOS PREMIOS SE OTORGAN “TAL CUAL” Y SIN GARANTÍAS DE NINGÚN TIPO, YA SEAN EXPRESAS O IMPLÍCITAS, INCLUIDAS, SIN LIMITACIÓN, LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD O IDONEIDAD PARA UN PROPÓSITO PARTICULAR. ALGUNAS JURISDICCIONES PUEDEN NO PERMITIR (O PUEDEN LIMITAR) LAS EXENCIONES DE CIERTAS GARANTÍAS, EN CUYO CASO LAS EXENCIONES ANTERIORES SE APLICARÁN EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY.
- Derechos de publicidad y uso de información personal: Salvo donde la ley lo prohíba, al participar en el Sorteo ofrecida por el Patrocinador o al aceptar un premio, usted otorga al Patrocinador y/o a sus designados el derecho a utilizar su nombre, fotografía, imagen, declaraciones, información biográfica, voz, ciudad y estado de residencia, y otra información identificativa con fines publicitarios y promocionales relacionados con el Sorteo en el que haya participado, así como para cualquier otro fin publicitario y promocional, a nivel mundial y de forma perpetua, en cualquier medio de comunicación, ya sea actualmente conocido o desarrollado en el futuro, sin compensación adicional, ni derechos de revisión o aprobación, notificación o permiso. Al participar en el Sorteo ofrecido por el Patrocinador o al aceptar un premio, usted reconoce que compartirá su información personal con el Patrocinador y acepta que el Patrocinador pueda utilizar dicha información personal con fines de marketing y otros fines. Usted podrá darse de baja de las notificaciones del Patrocinador relacionadas con futuras ofertas promocionales o de marketing en cualquier momento a través de su cuenta, en la pestaña Preferencias, haciendo clic en “preferencias de correo electrónico”.
USTED ADEMÁS RECONOCE Y ACEPTA QUE SU INFORMACIÓN PERSONAL IDENTIFICABLE PODRÁ SER DIVULGADA A TERCEROS, INCLUYENDO, SIN LIMITACIÓN, LA INCLUSIÓN DE SU NOMBRE EN UNA LISTA DE GANADORES.
- Ley aplicable y controversias: El Sorteo se regirá por las leyes internas del Commonwealth de Massachusetts. Cualquier acción legal o reclamación que surja en relación con el Sorteo deberá interponerse ante un tribunal de jurisdicción competente dentro del Commonwealth de Massachusetts. Salvo donde la ley lo prohíba, cada participante acepta que: (i) todas y cada una de las disputas, reclamaciones y causas de acción que surjan de o estén relacionadas con el Sorteo o con cualquier premio se resolverán de manera individual, sin recurrir a ningún tipo de acción colectiva, y exclusivamente ante tribunales estatales o federales ubicados en Boston, Massachusetts; (ii) todas y cada una de las reclamaciones, sentencias y adjudicaciones se limitarán a los costos reales de bolsillo efectivamente incurridos, pero en ningún caso incluirán honorarios de abogados; (iii) no se otorgarán daños punitivos, incidentales, especiales, consecuentes ni de ningún otro tipo, incluidos, sin limitación, lucro cesante (colectivamente, los “Daños Especiales”); y (iv) el participante renuncia por la presente a todo derecho a reclamar Daños Especiales y a todo derecho a que dichos daños sean multiplicados o incrementados.
- Condiciones de participación y limitación de responsabilidad: Al participar en el Sorteo ofrecido por el Patrocinador, cada participante acepta las condiciones establecidas en estas Reglas Generales y en las Reglas Oficiales aplicables, acepta quedar obligado por las decisiones del Patrocinador y garantiza que cumple con los requisitos para participar en el Sorteo.
Al participar en el Sorteo, los participantes liberan, eximen de responsabilidad, se comprometen a no demandar y exoneran de manera permanente al Patrocinador, a sus respectivas empresas matrices, afiliadas, subsidiarias, minoristas, divisiones, distribuidores, agencias de publicidad y promoción, y a todas las demás personas o entidades asociadas con el desarrollo y la ejecución del Sorteo, así como a los directores, empleados, funcionarios y agentes de cada una de las anteriores, de y frente a toda reclamación, acción, daño, pérdida, responsabilidad, costo, gasto, lesión o causa de acción de cualquier tipo que, de cualquier manera, surja ahora o en el futuro de o esté relacionada con el Sorteo, incluyendo, sin limitación: (i) la administración del Sorteo, incluyendo, sin limitación, errores tipográficos, de impresión, de distribución, humanos u otros relacionados con o en conexión con el Sorteo, el procesamiento de entradas, la selección de ganadores o el anuncio del(los) ganador(es) del premio; entradas inexactas, fraudulentas, incompletas, ilegibles, tardías, perdidas, robadas, enviadas a una dirección incorrecta, no entregadas, incompletas o dañadas; cualquier retraso en la entrega o falta de disponibilidad del premio o de los materiales del premio; y/o (ii) la participación de los participantes en el Sorteo ofrecida por el Patrocinador, la aceptación o el uso de un premio, o la participación en cualquier actividad relacionada con el premio, incluyendo, sin limitación, cualquier viaje relacionado con ello, así como muerte y lesiones corporales (incluido el daño emocional), debidas total o parcialmente, directa o indirectamente, a la participación en el Sorteo o en cualquier actividad relacionada con el Sorteo; y cualquier reclamación o causa de acción basada en derechos de publicidad, difamación o invasión de la privacidad, así como responsabilidad, pérdida o daños que surjan de o en relación con la adjudicación, recepción y/o uso o uso indebido de cualquier premio, o la participación en cualquier actividad relacionada con el premio.
El Patrocinador se reserva el derecho, a su entera discreción, de descalificar a cualquier persona que se determine que: (i) actúa en violación de estas Reglas Generales y/o de las Reglas Oficiales aplicables; o (ii) actúa de manera antideportiva o disruptiva, con la intención de perturbar o socavar el funcionamiento legítimo del Sorteo, o con la intención de molestar, abusar, amenazar o acosar a cualquier otra persona.
El Patrocinador se reserva el derecho de modificar estas Reglas Generales o las Reglas Oficiales en cualquier momento, y es su responsabilidad revisar estas Reglas Generales y las Reglas Oficiales para conocer cualquier cambio. Al participar en el Sorteo o aceptar un premio después de que se realicen cambios a estas Reglas Generales o a las Reglas Oficiales, usted acepta todos dichos cambios.
El Patrocinador podrá reprogramar, retrasar, posponer, alterar o modificar el Sorteo, o cancelarla por completo, en el caso de que el Patrocinador determine, a su entera discreción, que el Sorteo no puede continuar según lo previsto. Sin limitar lo anterior, en caso de que ocurra un Evento de Fuerza Mayor (según se define a continuación), el Patrocinador podrá reprogramar, retrasar, posponer, alterar o modificar el Sorteo, o cancelarlo por completo. A los efectos del presente documento, un “Evento de Fuerza Mayor” significa la interrupción o interferencia sustancial en la capacidad del Patrocinador para llevar a cabo, ejecutar o administrar el Sorteo y/o para otorgar un premio, causada por cualquier motivo o acontecimiento que no esté dentro del control razonable del Patrocinador, incluyendo, sin limitación, incendio, inundación, epidemia, pandemia, terremoto, explosión, huracán, amenaza o actividad terrorista, emergencia de salud pública (por ejemplo, COVID-19), acto de Dios o de enemigo público, fallas de satélite o de equipos, disturbios o alteraciones civiles, guerra (declarada o no declarada), o cualquier ley, orden o reglamento federal, estatal o local, o cualquier orden judicial o ejecutiva. En el caso de que el Sorteo sea terminado o cancelado por cualquier motivo, el valor comercial aproximado del(de los) premio(s) se otorgará en la medida en que así lo exija la ley.
