PROMOTION REQUIREMENTS AND ELIGIBILITY
 
The promotional offer is valid on 6/20/2025 between 9:00 AM Eastern Time (ET) and 5:15 PM ET (the “Promotional Period”). Must be physically located in Virginia (the “Eligible Jurisdiction”). Must be 21+ years of age or older. Any person who is found to be ineligible to play on DraftKings (i.e., by way of self-exclusion from gambling, restriction due to employment, or otherwise) may not participate in this Promotion and immediately forfeits any prizes which have been awarded under this Promotion. Each person who is eligible to enter the Promotion and enters the Promotion is referred to as a “Contestant” in these Rules and collectively, the “Contestants”. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

In addition to the eligibility requirements set forth above and in the DraftKings Terms of Use, to participate in the Promotion, Contestants must: (1) come through the DraftKings activation space at the Breezy Open event and (2) take one (1) attempt at hitting their shot within the designated area on the driving range.


By entering and participating in the Promotion, Contestants consent to the release of certain personal information to DraftKings for purposes related to participation and eligibility for participation in the Promotion, as well as marketing communications for DraftKings products and services. Contestants also agree to agree to respond in a timely manner to DraftKings’ reasonable requests, including, but not limited to, requests for information to execute documents as DraftKings may reasonably request and within the time frames communicated by DraftKings for purposes of any prizing earned from this Promotion.

OPERATION OF THE PROMOTION

The Promotion will be held at Independence Golf Club. 600 Founders Bridge Blvd, Midlothian, VA 23113 during the Promotional Period. Contestants will receive one (1) attempt to hit their shot within the designated area on the driving range. A DraftKings representative will be on site to verify each shot that lands within the designated area on the driving range. Contestants who land their shot within the designated area on the driving range will win a prize.

PRIZING AND PRIZE LIMITATIONS

The Contestants who hit their shot within the designated area on the driving range will win one (1) $10 Bonus Bet. Contestants’ shots must land within the designated area to be eligible for a prize. Contestants must have a valid DraftKings Sportsbook account to receive and redeem their Bonus Bet prize. DraftKings representatives will be on site to help credit Contestants’ accounts with their prize.

Bonus Bets are single-use, non-transferable, non-withdrawable, and have no cash value. Bonus Bets are valid for seven (7) days (168 hours) from the time they are credited to customers’ accounts. Customers can choose when to use Bonus Bets and must select the Bonus Bet in their betslip before placing a wager. Failure to use a Bonus Bet before expiration will void the reward. Payouts from Bonus Bet wagers will be transferred to the customer’s cash balance and do not include the Bonus Bet stake. Ex: If a $10 bonus bet is placed at +100 odds and wins, only the profit of $10 will be credited to the customer’s account. Bonus Bets may not be combined with other bonus rewards and may not be eligible for use on all promotions and/or betting markets.


GENERAL TERMS AND CONDITIONS

Limit one (1) offer per Contestant. Reward substitutions or changes will be made in DraftKings’s sole discretion. See DraftKings Sportsbook Terms of Use for information and limitations on wagering. Each Contestant will be notified when they have received a reward by (1) a bell notification (this is a notification that displays as a bell icon on the home page of the DraftKings Sportsbook app and website that can be clicked on to view short confirmation copy and terms) and/or (2) an automatically triggered email if the Contestant successfully entered the promotion and completed the promotion requirements. Should you wish to cancel your participation in this promotion at any time, please contact customer experience at sportsbook@draftkings.com. Upon cancellation, you may withdraw any remaining funds deposited in connection with this promotion subject to DraftKings Terms of Use. However, any applicable bonus rewards in your account shall be void, subject to forfeiture, and may not be transferred or withdrawn. All promotions are subject to the DraftKings Terms of Use and Privacy Policy. By accepting any bonus rewards, registered DraftKings customers agree to abide by the terms and conditions of this Promotion. Promotional offer is subject to regulatory approval. Void where prohibited by law. DraftKings account holders are responsible for any and all local, state, or federal taxes. To the extent permitted by applicable law, by entering or participating in the Promotion, each Contestant hereby agrees and consents, without further authorization, compensation, or remuneration of any kind, to the editing, modification, replication, publication, and/or other use of the Contestant’s name, likeness, photographs, videos, voice, entries, selections, and the like, in any medium, whether now known or hereafter developed, including without limitation, in any and all advertising, promotions, and other publicity conducted by DraftKings, whether in connection with the administration of the Promotion or the development, production, distribution, commercialization, promotion, and/or exploitation of DraftKings or the Promotion. To the extent permitted by applicable law, by entering or participating in the Promotion, each Contestant hereby agrees, without any compensation, to sign any releases, assignments, or authorizations related to publicization of Contestant’s name, likeness, photographs, videos, voice, entries, selections, and the like.

In the event a Contestant engages in behavior that, as determined by DraftKings in its sole and absolute discretion, for any reason or no reason, is obnoxious or threatening, illegal, or that is intended to annoy, abuse, threaten, or harass any other person, DraftKings reserves the right to remove the Contestant from the Promotion and/or revoke or reclaim the Contestant’s prize(s) (in the event any). In such event, and without limiting any other rights of DraftKings, the Contestant may also be required to reimburse DraftKings for any prizing.

DraftKings reserves the right to change, modify, suspend, delay, or cancel the Promotion at any time, in its sole and absolute discretion, for any reason or no reason. Whether a Contestant has committed abuse of this Promotion or violated the Terms will be determined by DraftKings in its sole discretion, for any reason or no reason at all. All promotions are subject to the DraftKings Terms of Use and Privacy Policy. By accepting any prize, Contestants agree to abide by the Terms of this Promotion. Contestants are responsible for any and all local, state, or federal taxes.

BY ENTERING AND/OR PARTICIPATING IN THE PROMOTION YOU UNDERSTAND AND AGREE THAT DRAFTKINGS AND ITS AFFILIATES LIMIT THEIR LIABILITY IN CONNECTION WITH YOUR ENTRY INTO AND PARTICIPATION IN THE PROMOTION AS SET FORTH IN THESE PROMOTION TERMS. UNDER NO CIRCUMSTANCES SHALL DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, OR ASSIGNS, OR THE DIRECTORS, OFFICERS, EMPLOYEES, OR OTHER REPRESENTATIVES OF ANY OF THE FOREGOING (COLLECTIVELY, THE “COMPANY ENTITIES AND INDIVIDUALS”), BE LIABLE TO YOU FOR ANY LOSS OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY, ECONOMIC, PUNITIVE, OR CONSEQUENTIAL DAMAGES) THAT ARE DIRECTLY OR INDIRECTLY RELATED TO: (1) THE PROMOTION, THESE RULES, YOUR ENTRY INTO AND PARTICIPATION IN THE PROMOTION; (2) CONTENT, PRODUCTS, SERVICES, AND PROMOTIONS AT THE EVENT OR YOUR UPLOADED INFORMATION, EVEN IN THE EVENT FORESEEABLE OR EVEN IN THE EVENT THE COMPANY ENTITIES AND INDIVIDUALS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR TORT (INCLUDING, WITHOUT LIMITATION, WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, TELECOMMUNICATIONS FAILURE, OR THEFT OR DESTRUCTION). IN NO EVENT WILL THE COMPANY ENTITIES AND INDIVIDUALS BE LIABLE TO YOU OR ANYONE ELSE FOR LOSS OR INJURY, INCLUDING, WITHOUT LIMITATION, DEATH OR PERSONAL INJURY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE COMPANY ENTITIES AND INDIVIDUALS’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED ONE HUNDRED DOLLARS ($100). THE COMPANY ENTITIES AND INDIVIDUALS ARE NOT RESPONSIBLE FOR ANY DAMAGE TO ANY CONTESTANT’S EQUIPMENT OR TECHNOLOGY WHETHER BY TECHNICAL OR OTHER MALFUNCTION. YOUR PARTICIPATION IN THE PROMOTION IS AT YOUR RISK. IN THE EVENT YOU ARE DISSATISFIED WITH THE PROMOTION, YOUR SOLE AND EXCLUSIVE REMEDY IS TO FORFEIT THE PROMOTION. YOU RECOGNIZE AND CONFIRM THAT IN THE EVENT YOU INCUR ANY DAMAGES, LOSSES, OR INJURIES THAT ARISE OUT OF THE ACTS OR OMISSIONS OF ANY OF THE COMPANY ENTITIES AND INDIVIDUALS, THE DAMAGES, IN THE EVENT ANY, CAUSED TO YOU ARE NOT IRREPARABLE OR SUFFICIENT TO ENTITLE YOU TO AN INJUNCTION PREVENTING THE CONTINUATION OF THE PROMOTION OR ANY EXPLOITATION OF CONTENT DEVELOPED, PRODUCED, AND/OR DISTRIBUTED BY ANY OF THE COMPANY ENTITIES AND INDIVIDUALS, AND YOU WILL HAVE NO RIGHTS TO ENJOIN OR RESTRAIN THE DEVELOPMENT, PRODUCTION, DISTRIBUTION, ADVERTISING, EXHIBITION, OR EXPLOITATION OF THE PROMOTION, ANY DRAFTKINGS WEBSITE, OR OTHER PROPERTY OR ANY AND ALL ACTIVITIES OR ACTIONS RELATED THERETO. BY ENTERING INTO AND PARTICIPATING IN THE PROMOTION, YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED. ACCORDINGLY, YOU AGREE TO WAIVE THE BENEFIT OF ANY LAW, INCLUDING, TO THE EXTENT APPLICABLE, CALIFORNIA CIVIL CODE SECTION 1542, THAT OTHERWISE MIGHT LIMIT YOUR WAIVER OF SUCH CLAIMS.

The exclusive jurisdiction and venue for proceedings involving any and all disputes, claims or controversies arising out of or relating to the Promotion or these Terms shall be the courts of competent jurisdiction sitting within Suffolk County, Massachusetts (the “Forum”), and each Contestant hereby waives any argument that any such court does not have personal jurisdiction or that the Forum is not appropriate or convenient. These Terms shall be governed by the internal substantive laws of the Commonwealth of Massachusetts, without respect to its conflict of laws principles.

The best interests of the Promotion and fairness are top priorities in decision-making. DraftKings reserves the right to make reasonable exceptions to these Terms where circumstances so require or warrant. DraftKings shall have the sole and absolute discretion to interpret and enforce these Terms, and such interpretation and decisions related thereto are final.
