- Acknowledgement: As a condition of participating in the Sweepstakes, you agree to be fully and unconditionally bound by these 10/17/2024 DK Casino – Barstool Giveaway Sweepstakes Official Rules (these “Official Rules”), the DraftKings General Rules (the “General Rules”), and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and you agree to fully and unconditionally waive any right to claim ambiguity in the Sweepstakes, the Official Rules, or the General Rules. The General Rules are attached as Exhibit A to these Official Rules and are incorporated herein by reference.
- Entry Period: The Sweepstakes begins at 6:00:0 PM on October 17, 2024 and ends at 11:59:59 PM on October 18, 2024 (the “Entry Period”). All references to time of day contained herein refer to the prevailing Eastern Time Zone. Sponsor’s computer shall be the official clock for all purposes of the Sweepstakes.
- Disclaimer: As a condition of participating in the Sweepstakes, you agree and acknowledge that X Corp. and its owners, directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated corporations and entities (collectively, the “Social Media Platform”) are not sponsors of the Sweepstakes nor do they endorse or administer the Sweepstakes, nor are they in any way associated with the Sweepstakes. All questions regarding the Sweepstakes must be directed to Sponsor, not the Social Media Platform. You also agree that as a condition of participating in the Sweepstakes, you shall release the Social Media Platform from any and all liability arising out of or relating to your entry, creation of an entry, submission of an entry, participation in the Sweepstakes, acceptance, use, or misuse of any prize, or the broadcast, exploitation, or use of an entry.
- Eligibility: The Sweepstakes is open only to individual legal residents of the United States who, at the time of opt-in entry into the Sweepstakes: (i) are physically located in a Participating State; (ii) are at least twenty one (21) years of age; (iii) have an Online DraftKings Casino account in good standing; (iv) have a valid X (formerly known as Twitter) account; (v) are not voluntarily (e.g., self-exclusion) or involuntarily excluded from play on any DraftKings website or mobile application; (vi) are not included on any jurisdiction-wide gaming or daily fantasy sports exclusion list; (vii) are not temporarily or permanently banned from playing on any DraftKings website or mobile application; (viii) maintain their Online DraftKings Casino account and any other DraftKings accounts in good standing; (ix) satisfy all other requirements contained herein; and (x) at all times abide by these Official Rules. Sponsor reserves the right during the Entry Period to add additional Participating State(s), provided that in the event any such additional Participating State(s) are added, participants from such additional Participating State(s) shall be required to comply with these Official Rules. Employees, officers, and directors of Sponsor and each of Sponsor’s affiliates, agents, and advertising, public relations, and promotion agencies, and members of each of the preceding’s immediate families (i.e., spouses, parents, children and siblings, and their respective spouses) and those living in the same household are not eligible to enter the Sweepstakes.
- How to Enter: There is only one (1) method of entry for the Sweepstakes. You must enter by: (1) following @DKCasino on X (formerly known as Twitter); and (2) “like” the @DKCasino tweet referencing the Sweepstakes. Both steps must be completed for proper entry into the Sweepstakes. Any entry received outside of the Entry Period will be deemed ineligible. In the event you do not have an existing X account, you can create one for free. To create a X account, visit https://x.com and complete the onscreen instructions to sign up for an account. To “follow” @DKCasino on X, login to your X account and select “search” from the tool bar of the home page. When the search box appears, enter “@DKCasino”. Select the @DKCasino icon and then click the “Follow” button. To “like” the @DKCasino tweet referencing the Sweepstakes, navigate to the specific post and click the heart icon underneath the tweet. Any entry received outside of the Entry Period will be deemed ineligible. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. In the event you are entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.
Limit: one (1) entry per person. Anyone found to be using multiple accounts to enter the Sweepstakes, violating the Social Media Platform’s terms of service, or liking the sweepstakes post multiple times will be deemed ineligible for the Sweepstakes, and all of their entries may be deemed void. Automated and/or third-party entries are prohibited and will be disqualified. Multiple entrants are not permitted to share the same email address and/or X account. Any attempt by any entrant to obtain entries by using multiple and/or different identities, forms, registrations, addresses, or any other method will void all of such entrant’s entries, and such entrant may be disqualified at Sponsor’s sole discretion. Sponsor shall not be liable for any problems that occur during the entry process, including, without limitation, late, incomplete, delayed, undelivered, misdirected, or invalid entries, and Sponsor shall not have any obligation to advise an entrant of a late, incomplete, delayed, undelivered, misdirected, or invalid submission or entry. No illegible, incomplete, forged, or altered entries will be accepted. Proof of liking to the Sweepstakes tweet does not constitute proof of receipt or entry into the Sweepstakes. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address associated with the X account used to enter the Sweepstakes will be deemed to be the proper entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized X account holder.
- Prizes and Odds of Winning: Odds of winning depend on the number of eligible entries received during the Entry Period. Subject to verification of eligibility and compliance with these Official Rules and the General Rules, five (5) winners of the Sweepstakes will receive one (1) ONE HUNDRED U.S. DOLLARS ($100) DraftKings Casino credit to be used on their Online DraftKings Casino account (the “Prize”). Total Approximate Retail Value of a Prize: ONE HUNDRED U.S. DOLLARS ($100)
Prize Restrictions: Each entrant can only win one (1) Prize. Only the number of Prizes stated in these Official Rules are available to be won in the Sweepstakes. In the event, by reason of a print or other error, more Prizes are claimed than the number set forth in these Official Rules, Prize winner(s) will be selected in accordance with the winner selection method described in these Official Rules from among all eligible claimants making purportedly valid claims in order to award the advertised number of Prizes available. The Prize will be deposited into the winner’s Online DraftKings Casino account. Winner must have an Online DraftKings Casino account to receive a Prize. In the event that the winner does not have an existing Online DraftKings Casino account, the winner may create an Online DraftKings Casino account at https://casino.draftkings.com/casino and click the “Log In / Sign Up” button. Sponsor is not liable for computer, internet, or program malfunctions, nor for errors in Prize. Sponsor will not replace the Prize in the event it is lost or stolen. Sponsor is not responsible for any delay or cancellation of Prize delivery due to unforeseen circumstances or circumstances outside of its control. The winner may only use the DraftKings Casino credit when physically located in a Participating State. Additional restrictions, conditions, and limitations may apply.
- Selection of Winner: On or about October 21, 2024 Sponsor will randomly select one (1) potential winner from among all eligible entries received during the Entry Period. The potential winner will be notified by Sponsor on or about October 21, 2024. Sponsor will notify the potential winner by direct message via X to the account used to enter the Sweepstakes. A valid Online DraftKings Casino account is required to receive the Prize. In the event a potential winner cannot be contacted or does not respond within twenty-four (24) hours, an alternate potential winner may be selected.
