DraftKings Rewards Program Tier Trial Terms & Conditions

Thank you for choosing to participate in this promotion (the “Promotion”) being offered by DraftKings. By entering or participating in the Promotion you hereby agree to be bound by these Promotion terms (the “Promotion Terms,” together with the DraftKings Terms of Use and General Rules, the “Terms”). If you do not wish to be bound by the Promotion Terms, please do not enter or participate in the Promotion. 1. DESCRIPTION
 
Customers can receive a 83 day trial status in the DraftKings Rewards Program at the [SILVER/GOLD/DIAMOND/ONYX] tier (the “Trial Status”).
 
2. DATE AND TIME OF PROMOTION
 
The promotional offer is valid between 10/9/2026 at 12:00 AM Eastern Time (ET) and 1/1/2027 at 3:00 AM ET (the “Promotional Period”).
 
3. ELIGIBILITY

 To be eligible for the Promotion, you must be physically located in a:
Sportsbook eligible jurisdiction: AR, AZ, CO, CT, DC, IA, IL, IN, KS, KY, LA (select parishes), MA, MD, ME, MI, MO, NC, NH, NJ, NY, OH, OR, PA, PR (residents only), TN, VA, VT, WA, WV or WY, CA-AB, or CA-ONT
Casino Eligible Jurisdiction: CT, MI, NJ, PA, or WV
(each an “Eligible Jurisdiction” or, collectively, the “Eligible Jurisdictions”). Must be 21+ years of age or older (18+ if in CA-AB/DC/NH/PR/WY) (19+ if in CA-ONT).

Any customer who is found to be ineligible to play on DraftKings (i.e., by way of self-exclusion from gambling, restriction due to employment, or otherwise) may not participate in this Promotion and immediately forfeits any bonus rewards which have been awarded under this Promotion.

Customers must be invited to receive this Promotion. Promotion is only valid for the intended recipient – customers who receive this offer via an email forward, screenshot, or other means shall not be eligible.

4. REQUIRED ACTIONS
 
In addition to the eligibility requirements set forth above and in the Terms, to participate in the Promotion, customers must (1) be a registered DraftKings customer with an active account; (2) receive an invitation or offer to participate in this Promotion from DraftKings; and (3) accept the offer during the Promotional Period.
  
 
5. BONUS REWARD REDEMPTION AND LIMITATIONS

Upon completion of the Promotion requirements, DraftKings will award the customer Trial Status for 83 days at the [SILVER/GOLD/DIAMOND/ONYX] tier beginning on date customer accepts the offer (the “Trial Period”).

During the Trial Period, the customer will receive the benefits generally available to customers at the applicable Trial Status tier, regardless of the customer’s deposits, wagers, play, or other activity.

Trial Status does not entitle a customer to all benefits, rewards, gifts, experiences, or other offers that may be available to customers who earn the same tier through qualifying activity on DraftKings. Without limitation, customers receiving Trial Status are not eligible for any Tier Reached Gift, Elite Rewards Gifts and Experiences, etc., unless DraftKings expressly states otherwise.

Trial Status and all associated benefits are subject to availability, the applicable DraftKings Rewards Program Terms, and DraftKings’ sole discretion.

7. LIMITS ON PARTICIPATION
 
Limit one (1) Trial Status offer redemption per customer per calendar year (e.g., 1/1/2026 through 12/31/2026). Trial Status is personal to the eligible customer, has no cash value, and may not be sold, transferred, exchanged, or combined with another status trial or promotional offer unless DraftKings expressly permits it.

Reward substitutions or changes will be made in DraftKings’ sole discretion. See DraftKings Terms of Use for information and limitations on wagering.

The customer is not eligible for certain other benefits or tier status gifts that may be offered to other customers within the same loyalty tier, including but not limited to Elite Rewards Gifts and Experiences, Tier Reached Gift, etc. These extended benefits are exclusively available to customers who have earned their tier status through game play, wagering, or other actions on DraftKings platforms.
 
8. WAGERING RESTRICTIONS AND LIMITATIONS

There are no deposit, wagering, or play requirements to receive the Trial Status or to use the regular benefits available during the Trial Period.

To retain the applicable Trial Status through the 2027 earning year, the customer must earn the required number of Tier Credits during the Trial Period:

• Gold: 7,000 Tier Credits
• Diamond: 25,000 Tier Credits
• Onyx: 40,000 Tier Credits]

If the customer earns the applicable Tier Credit threshold during the Trial Period, DraftKings will extend the customer’s applicable status tier through 1/3/2028 at 3AM ET, subject to the DraftKings Rewards Program Terms.

If the customer does not earn the applicable Tier Credit threshold during the Trial Period, the customer’s status after the Trial Period will be determined based on the total number of Tier Credits the customer has earned, in accordance with the DraftKings Rewards Program tier requirements, unless DraftKings determines otherwise in its sole discretion.

DraftKings may, in its sole discretion, review a customer’s activity and determine whether to extend, modify, or decline to extend the customer’s status beyond the Trial Period. Any such decision is discretionary and does not create an entitlement to a status extension.

Tier Credits:

Tier Credits are a form of player loyalty points (“Tier Credits”) offered by the DraftKings Rewards Program. Players with an active and valid account created and maintained pursuant to the applicable Terms of Use will be automatically enrolled in the Program and eligible to earn Tier Credits, subject to any requirement for eligibility set forth herein. A player’s eligibility for the Program and their Tier Credits balance may be revoked or modified by DraftKings at any time, for any reason or no reason. The provision, duration, value, and/or revocation of Tier Credits may be modified at any time in DraftKings’ sole discretion. Tier Credits will be automatically credited to the player’s Tier Credit balance. Tier Credits will accrue on a fractional basis; however, a player’s Tier Credit balance will only display the total Tier Credit amount as a whole number (rounded down). Tier Credits balances expire and reset to zero (0) annually on January 3. Players may view their Tier Credit balance at any time on any DraftKings site. The rate at which Tier Credits are accrued varies based on contest, wager, bet type, entry fee, or purchase price. The accumulation of Tier Credits does not entitle players to any vested rights with respect to any rewards. 9. ORDER OF FUNDS USED FOR WAGERING
 
Funds are wagered in the following order: (i) DK Dollars, then (ii) Cash in your cash balance.

11. RESTRICTIONS ON WITHDRAWAL OF FUNDS
 
You may withdraw funds deposited in connection with this Promotion subject to the Terms. Any wager placed on DraftKings in connection with the Promotion cannot be rescinded once it has been placed. Subject to any play-through restrictions in connection with a promotion, funds earned from winnings may be withdrawn at any time.
 
12. RULES REGARDING CANCELLATION
 
Should you wish to cancel your participation in this promotion at any time, please contact customer experience at support@draftkings.com. Upon cancellation, you may withdraw any remaining funds deposited in connection with this promotion subject to the Terms. Any wager placed on DraftKings in connection with the promotion cannot be rescinded once it has been placed. However, any applicable bonus rewards in your account shall be void, subject to forfeiture, and may not be transferred or withdrawn.

14. OTHER INFORMATION
 
Whether a customer has committed abuse of this Promotion, or violated the Terms, will be determined by DraftKings in its sole discretion, for any reason or no reason at all. All promotions are subject to the DraftKings Terms of Use and Privacy Policy. By accepting any bonus rewards, registered customers agree to abide by the Terms. Promotional offer is subject to regulatory approval. Void where prohibited by law. DraftKings account holders are responsible for any and all local, state, or federal taxes. DraftKings is not liable for computer or program malfunctions, nor for errors in bonus rewards. DraftKings reserves the right to exclude or remove certain customers from this Promotion, as well as the right to withhold bonus rewards if you have violated or attempted to violate the Terms, including but not limited to sharing account credentials with other individuals, placing wagers on behalf of other individuals, circumventing DraftKings age and location verification procedures, and abusing the DraftKings Platform, the Services, or any bonuses, the refer-a-friend program, or any other offers or promotions, including this Promotion, in any way.
 
If physically located in PA, this Promotion will comply with subsection §813.3 regarding cancellation in this Promotion by a customer. If in NY, if a customer is dissatisfied with any resolution between the customer and DraftKings, the customer may then submit an inquiry with the New York State Gaming Commission.
